WATER LITIGATION

An interesting situation which is likely to be litigated has arisen at Birmingham, Ala., involving the disposal of the municipal waterworks plant at North Birmingham, which is to be annexed to Birmingham. North Birmingham, on the eve of its annexation, has voted to sell its water plant for $1, and the assumption of the bonded indebtedness, amounting to $190,000, by the purchasers. The Birmingham authorities on their part contend that a municipality has no legal right to dispose of a public utility. It is likely the mayor of Birmingham, through the city attorney, will ask tor a restraining order.

Suit was recently brought against the city of Elyria, Ohio, and the water service board to enjoin the latter from shutting off the water supply at Memorial hospital, or collecting the rental demanded from the institution by the board.
