James Cummings lost his place as clerk in the Fire Department on August 31. 1877. and was restored by order of the Supreme Court on March 20,1878. He sued the city in the Common Pleas Court to recover his salary for the intermediate period, and the city put in the customary defence, that it has paid the salary already to the clerk appointed in his place, and who did his work in the meantime. Judge Van Brunt on Wednesday last directed a verdict for the plaintiff for the amount claimed—$735E. D. Hatch for the plaintiff: Assistant Corporation-Counsel Dean for the city.

The annual election of the Middletown, N. Y., Fire Department, passed off very quietly, there being no opposition to the regular ticket, and consequently not a full vote polled. The following were elected : Chief Engineer, Ferris M. Pronk, of Excelsior Hook and Ladder Company; First Assistant, Charles V. Puff, of Phoenix Engine Company; Second Assistant, Joseph Massey, of McQuoid Engine Company; Clerk, H. C. Ogden, of Monhagen Hose Company; Treasurer, Ira M. Corwin, of Eagle Hose Company.
