The work contemplated by the drainage law is in some respects a reversal of natural laws, and in many respects is experimental. The plan is necessarily general and specific, and what the cost may be nobody whose opinion is worth taking ventures to estimate. A river not feeding Lake Michigan, but to be fed thereby, is to be made by the construction of artificial channels. A current of three miles an hour from Lake Michigan through the wide and deepened canal or through the Des Blaines, also widened where necessary and deepened, is contemplated. It may in fact be more or it may be less. A steadily Bowing stream is fraught with less danger of overflow than a stream whose volume is enhanced by darns. So far as these exist in the Illinois river they are to be removed upon the presumption that all necessary flow of water for navigable purposes will be had from Lake Michigan to the Mississippi by means of the great cut made at the cost of the Chicago sanitary district.

One section of the drainage law provides that every sanitary district shall be liable for all damages to real estate within or without such district which may be overflowed or otherwise damaged by reason of the construction, enlargement or use of any channel, ditch, dtain, outlet or other improvement under the provisions of the act, and actions to recover such damages may be brought in the county where such real estate is situate, or in the county where such sanitary district is located, at the option of the party claiming to be injured. And in case judgment is rendered against such district for damage, the plaintiff shall also recover his reasonable attorney's fees, to be taxed as costs of suit.
