According to an opinion of Judge Frazer the McKeesport. Pa., Water company is compelled to furnish customers with water in times of drought, even if the water must be purchased from a rival company. The plaintiffs claimed that during the dry spell last summer the water company was unable to furnish water in sufficient quantity to East McKeesport consumers, and the Pennsylvania Water company was willing to sell the water to supply the deficiency, but the offer was refused. The answer of the water company to the bill contended that the price of water to he furnished by the Pennsjdvania Water company was too high to enable them to make a profit. The Court in its opinion finds that it was obligatory on the defendant company to fulfill its contracts.
