WATER SUPPLY ITEMS.
The city of Omaha has no right to appropriate any part of the water works plant without taking all that belongs to it as a necessary part of a going concern. To talk about purchasing the present system of pipes and mains without the works at Florence is the veriest bosh.
By a decision of Judge Sayler in the Common Pleas Court at Cincinnati, the management of the receipts and expenditures of the water-works was taken from the board of administration. It was in the suit of Wm. M. Ampt against the city. Mr. Ampt asserted that the receipts of the water-works were being expended without authority of law ; that the proper method was for an estimate to be made by the different departments of the works, which estimate should be included in the ordinance prepared by the city auditor and sent to the board of legislation for the purpose of making the appropriation fop all city expenditures for six months. After that ordinance has been passed by the board ot legislation the board of supervisors must approve it. Judge Sayler held that method to be the proper one and issued an injunction to prevent further expenditures. However, that order was suspended until December 31. In the meantime the estimates and other preparatory work for the appropriating ordinance will be prepared. The resuit is that hereafter the financial business of the waterworks will be on the same basis as all other departments of the city.
