The day has gone by when our lakes and rivers can be used as cesspools and drainage canals, and, unless the practice is put an end to at once, all through the United States, these State waters will be poisoned, and water-borne diseases will have it all their own way. So far as New York State is concerned, a bill on the subject, which ought to pass, has been introduced into the legislature by Senator Stewart, of Ithaca. It confers upon the State commissioner of health power to regulate or prohibit any new discharge of sewage or refuse either by municipalities or manufacturing establishments into the waters of the State. It will he seen that the bill does not interfere in any way with existing rights of sewage disposal, while it aims to put a stop to further pollution of waters. It provides that municipalities and others discharging waste into waters of the State must make a report of their situation, that the health authorities may have accurate information of the present condition of the waters. Henceforth anybody who desires to use streams for additional drainage, either by the construction of new sewerage systems or new factories. must obtain a revocable license from the commissioner of health. If the discharge proposed seems to be proper, he will grant the license for such time as may be consonant with public safety. If it seems to menace public health, he will refuse the permit and compel resort to some better method of waste disposal. Anyone who henceforth discharges waste into the waters of the State, except in accordance with vested rights, without obtaining such license. and anyone who continues to discharge waste in the exercise of a vested right without filing a report of the nature and extent of his operations, will be guilty of a misdemeanor.
