Any owner or other person having the control of such buildings or edifices who refuses or ne jlects to construct such guard rail within the time prescribed by this act, shall be guilty of a misdemeanor, and in addition thereto after notice given by such chief engineer or other officer, shall be liable to a penalty of $50 for every neglect or refusal to so construct such guard-rail.—Senator Lamy has introduced a bill providing that common councils shall designate a fire district in each city, and that within such district the floors and walls of buildings shall be constructed of fire-proof material and prohibiting the use of wood. The bill provides that after 1905 no buildings shall be allowed to remain within a fire district that has wood laths or wood furring in its construction, and which has not floors constructed of fire-proof material. After that date no building shall be used as a dwelling or theatre not consiructed as above provided.—Governor Morton has signed the act authorizing the Utica Water Company to increase its capital by borrowing $1,250,000.
