What may be Toledo’s longest-running civil lawsuit was dismissed before it was to have gone to trial Sept. 22, but officials said the lawsuit by three female firefighters is likely to be refiled, reports The Toledo Blade.
In 2005, Capt. Carla Stachura and firefighters Judi Imhoff and Geraldine McCalland filed a gender discrimination suit against the Toledo Fire Division, then-Chief Michael Bell, and then-Deputy Chiefs John Coleman and Robert Metzger.
The case was repeatedly delayed after rulings made by Lucas County Common Pleas Court Judge Linda Jennings were appealed to Ohio’s 6th District Court of Appeals.
Late last year, the Ohio Supreme Court declined to hear an appeal of the 6th District’s decision upholding Judge Jennings’ refusal to grant immunity to city fire officials. Last month, Judge Jennings refused a joint motion to continue the Sept. 22 trial date, prompting attorneys for both sides to ask the court to dismiss the case with the right to refile.
