“A municipal corporation is not liable for the torts or negligence of an officer whom it is required by law to appoint for the performance of a public duty laid upon the officer and from which it derives no special benefit." See. 744 “Members of a fire department as officers charged with a public service, are not the agents or servants of the city which appoints them and the city is therefore not liable for their negligent discharge of official duty.
